A few weeks ago my car was rear ended and has minor frame damage from the collision. The insurance adjustor's checked it out and offered me $700 to fix the paint on the bumper, repair the bumper support and 2 hours on a frame rack. Details about my car: The passenger rear taillight is pushed in about a centimeter - the quarter panel now sticks out a tad and is crumpled in the wheelwell - my passenger framerail has a warp in it from the accident. Now they are claiming that my car was in a previous accident because of filler paint or something in the trunk. They claim that because I have a hole cut into my frame rail that the car was previously pulled and that's where the damage came from. I drove the car for 4 years, I think I'd know if my taillight was pushed in and my quarter panel was sticking out. They told me to take it to an auto body to have it looked at and they would contact them on a final settlement - BUT I feel the car is unsafe to drive. I do not want to drive a car with previous frame damage (fixed). Would I be able to take the money and buy a different car without the body shop doing work on it?

Ran a red light in NYC, what can I do to avoid having my insurance increase?

Today, I ran a red light as I was going downhill in the rain to avoid hydroplaning into an intersection. As I ran the red light, a camera from above flashed and I'm 99% sure I'm getting a ticket in the mail now. I don't live in New York state (I live in South Dakota which is like 30 hours away), so I don't have a means of going down to the DMV in NYC once I get my ticket in the mail. I was in a low-impact car accident and went to the ER the next day to get checked up just incase. I went to my doctor because of back pain and when I mentioned I was in a car accident. They told me I could not go through my health insurance that it has to be through my car insurance. It turns out I have herniated discs and now my doctor has referred me to see an orthopedic surgeon but, I do not feel that the car accident was the cause of the herniated discs. I asked again if I can treatment through my health insurance and I was told by one of the office assistants that it is fraud if I use my health insurance. If I explain to my doctor that I fell down the stairs and insist that I do not want to through through my car insurance because I do not feel the car accident was the cause will he change his mind and refer me to the specialist using my health insurance or should I go through another doctor.
